§1Preamble

These Terms of Service (hereinafter "Terms") govern access to and use of the online platform Plaany, available at plaany.com, and its associated mobile apps (hereinafter the "Platform").

Plaany is a reverse marketplace connecting event planners ("Planners") with verified professionals ("Providers") in Belgium, France and the Netherlands.

By creating an account or using the Platform, the user acknowledges having read, understood and accepted these Terms without reservation.

§2Definitions

Platform
The Plaany online service (site, applications, API).
User
Any natural person holding a Plaany account, of legal age and legally capable.
Planner
User who publishes an event project and receives offers.
Provider
Verified professional (photographer, DJ, caterer, etc.) who sends offers and performs services.
Offer
Firm commercial proposal sent by a Provider in response to a project.
Agreement
Contract entered into directly between Planner and Provider upon offer acceptance.
Escrow
Secure third-party holding service operated by Stripe Payments Europe Ltd.
Deposit
Portion of the price (0 %, 20 % or 30 %) paid directly to the Provider at booking.
Balance
Remaining amount, held in escrow until 48 h after the service.
Commission
Plaany's fee, withheld on each completed transaction.

§3Eligibility

Access to the Platform is reserved for natural persons of legal age (18 years or older) or duly represented legal entities, legally capable and residing in the European Union or Switzerland.

Registration as a Provider requires a declared professional status (self-employed, company, non-profit with commercial activity…) and validation of a Stripe Connect account (mandatory KYC verification).

§4User account

4.1. Creation

Registration is free and requires a valid email address and a password of at least 8 characters. Sign-in via Google, Facebook or Apple is also available.

4.2. Dual role

A user may hold two roles simultaneously (Planner and Provider) on a single account, with view switching via the user menu.

4.3. Security

The user is responsible for keeping credentials confidential. Two-factor authentication (2FA) is recommended for Provider accounts. Any fraudulent use must be reported to hello@plaany.com.

4.4. Data accuracy

The user undertakes to provide accurate, complete and up-to-date information, including identity, contact details, company registration number (Providers) and billing address.

4.5. Suspension & closure

The user can delete their account at any time from settings. Plaany may suspend or close an account in case of serious breach of these Terms, after notification and — except in urgent cases — a reasonable cure period.

Plaany's role Plaany acts as a technical intermediary. Service contracts are entered into directly between Planner and Provider; Plaany is not a party to the service agreement itself.

§6Payment & escrow

Upon accepting an offer, the Planner pays the full price including VAT. Funds are then split as follows:

Accepted payment methods: credit/debit card (Visa, Mastercard, American Express), Bancontact, iDEAL, Apple Pay, Google Pay, SEPA Direct Debit.

Payments are exclusively processed by Stripe Payments Europe Ltd, regulated by the Central Bank of Ireland. Plaany never stores card data.

§7Commissions & Pro plan

7.1. Free for Planners

Using the Platform is entirely free for Planners: creating projects, receiving offers, messaging, payment. No hidden fees.

7.2. Provider commission

Plaany withholds a commission on each completed transaction. The exact rate is shown at every step of the payment funnel, before signing. This commission covers matching, secure payment, dispute mediation, and technical infrastructure.

7.3. Pro plan

Providers may subscribe to the Pro plan (€29 incl. VAT/month or €23 incl. VAT/month with annual billing), featuring:

The Pro plan can be cancelled anytime without commitment, from account settings. Cancellation takes effect at the end of the current period.

§9User content

9.1. User IP

Each user retains intellectual property rights over the content they publish (text, photos, videos, logos). By publishing, they grant Plaany a non-exclusive, worldwide, free licence for the duration of Platform use, strictly limited to service delivery (display, indexing, moderation).

9.2. Moderation

Plaany reserves the right to remove, modify or refuse any content that breaches these Terms or the law, after user notification except in urgent or court-ordered cases.

9.3. Reporting

Any user can report unlawful content via the "Report" button or by email at hello@plaany.com. Plaany commits to reviewing reports within 48 business hours.

§10Anti-disintermediation

To protect transaction security, it is strictly prohibited to:

The messaging includes an automatic filter detecting bypass attempts. In case of confirmed breach, Plaany may suspend the account, withhold the relevant funds, and charge a flat €300 penalty corresponding to the estimated economic loss.

§11Reviews & ratings

After a completed service, the Planner is invited to leave a review (1–5 stars + comment) about the Provider. Reviews are moderated after publication. The Provider can respond publicly in a constructive tone.

§12Force majeure

Neither Plaany nor users may be held liable for a failure resulting from force majeure (e.g. natural disaster, official health lockdown, terrorist attack, major outage of a third-party service). Specific cancellation terms in such cases are detailed in the Cancellation Policy.

§13Liability

Plaany undertakes a best-efforts obligation for Platform availability and proper operation. Plaany cannot be held liable for service execution quality (which falls exclusively on the Provider), commercial disputes between users beyond its mediation role, damages from improper use, or temporary interruptions tied to maintenance or third parties.

In any event, Plaany's total liability toward a user is limited to the amount of commissions collected over the past six months on the relevant account, except for gross or intentional fault.

§14Termination

Users may delete their account anytime. Ongoing transactions must be completed or cancelled under the Cancellation Policy. Plaany may terminate an account after an unremedied 14-day formal notice, or without notice in case of proven fraud, serious breach, or court order.

§15Modifications

Plaany may update these Terms anytime. Material changes are notified by email and in-app at least 30 days before effective date. Continued use after that period constitutes acceptance. Disagreeing users may terminate their account.

§16Governing law & mediation

These Terms are governed by Belgian law. In case of dispute, parties shall first seek an amicable resolution. Consumer users can freely refer to:

Failing an amicable solution, the courts of Brussels have jurisdiction, subject to mandatory consumer-protection rules.
